These Terms of Service ("Terms") govern your access to and use of Translate - Offline Translator (the "App"), operated by the developer ("we", "us", or "our"). By downloading, installing, or using the App, you agree to these Terms.
If you do not agree, do not install or use the App.
1. Eligibility
You must be at least the minimum age required by your country's law to enter into a binding contract (13 in the United States under COPPA, 16 in the European Union under GDPR, or as otherwise required locally) to use the App. If you are using the App on behalf of an organization, you represent that you have authority to bind that organization to these Terms.
2. License
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to install and use the App on iOS devices you own or control, for personal, non-commercial purposes.
You may not:
- Redistribute, resell, sublicense, or otherwise commercially exploit the App
- Reverse engineer, decompile, or disassemble the App, except to the extent expressly permitted by applicable law
- Use the App to violate any law or third-party right
- Interfere with or disrupt the App's security or operation
3. Subscriptions and Auto-Renewal
The App may offer auto-renewing subscriptions and one-time purchases (collectively, "Subscriptions") through Apple's In-App Purchase system.
- Free trial. If a free trial is offered, your subscription begins when you confirm the purchase in the App Store. You will not be charged during the trial. Unless you cancel at least 24 hours before the end of the trial, your subscription will automatically renew at the displayed price.
- Auto-renewal. Subscriptions automatically renew for the same period at the then-current price unless cancelled at least 24 hours before the end of the current period. Your iTunes/Apple ID account is charged within 24 hours before the end of the current period.
- Manage and cancel. You can manage and cancel your subscription at any time in Settings -> Apple ID -> Subscriptions on your device. Cancellation takes effect at the end of the current billing period.
- Pricing. Prices are displayed in the App Store and may vary by region and applicable taxes. Currency conversion and local taxes are handled by Apple.
- No partial refunds. We do not offer refunds for partial subscription periods, except as required by Apple or applicable law.
4. Remove Ads Entitlement
A paid purchase or active subscription may unlock a "removeAds" entitlement managed through RevenueCat. The entitlement:
- Removes in-app advertising for the duration of the active subscription, or permanently if purchased as a one-time upgrade
- Is associated with your Apple ID / App Store receipt and is restored when you restore purchases on a new device
- Is not transferable between accounts or platforms
5. Restore Purchases
If you reinstall the App or switch to a new device, use the in-app "Restore Purchases" option while signed in with the original Apple ID. We are not responsible for purchases that cannot be restored due to issues with your Apple ID or App Store account.
6. Translation Accuracy
The App performs on-device machine translation and on-device optical character recognition (OCR). Translations and OCR results are generated by statistical and neural models and may contain errors, omissions, or culturally inappropriate wording.
You agree that:
- Translations are provided for informational purposes only and should not be relied upon in legal, medical, financial, or other high-stakes contexts
- You are solely responsible for verifying translated content before acting on it
- We make no warranty as to the accuracy, completeness, or fitness of any translation
7. Acceptable Use
You agree not to use the App to:
- Translate or scan content that is unlawful, infringing, obscene, harassing, or otherwise objectionable
- Attempt to circumvent technical limitations or rate limits
- Upload or input personal data belonging to other individuals without their consent
- Use the App in any manner that could damage, disable, overburden, or impair our infrastructure
We may suspend or terminate your access if you violate this section.
8. Intellectual Property
The App, including its design, code, graphics, and on-device models, is owned by us or our licensors and is protected by copyright, trademark, and other laws. These Terms do not transfer any ownership rights to you.
9. Third-Party Services
The App integrates third-party services governed by their own terms:
- Google Mobile Ads (AdMob) - governed by Google's Terms of Service and the AdMob Program Policies
- RevenueCat - governed by the RevenueCat Terms of Service
- Google ML Kit - the on-device translation model is provided by Google and governed by the Google APIs Terms of Service
These services are required for the App to function and to support paid features and advertising.
10. Termination
We may suspend or terminate your access to the App at any time, with or without notice, if we reasonably believe you have violated these Terms. You may stop using the App at any time and delete it from your device. Upon termination, sections that by their nature should survive (including disclaimers, limitations of liability, and dispute resolution) will survive.
11. Disclaimer of Warranties
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ACCURACY OF TRANSLATIONS. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT DEFECTS WILL BE CORRECTED.
12. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL WE, OUR AFFILIATES, OR OUR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF DATA, LOSS OF PROFITS, OR LOSS OF GOODWILL, ARISING OUT OF OR RELATING TO YOUR USE OF (or IN)ABILITY TO USE THE APP, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE APP WILL NOT EXCEED THE AMOUNT YOU PAID US (IF ANY) FOR THE APP IN THE 12 MONTHS PRECEDING THE CLAIM, OR USD $30, WHICHEVER IS GREATER.
Nothing in these Terms excludes or limits liability that cannot be excluded under applicable law (such as death, personal injury, or fraud).
13. Indemnification
You agree to indemnify and hold us harmless from any claims, damages, or expenses (including reasonable attorneys' fees) arising out of your breach of these Terms or your use of the App.
14. Governing Law and Disputes
These Terms are governed by the laws of the jurisdiction in which the developer is established, without regard to conflict-of-laws principles. Any dispute arising out of or relating to these Terms will be resolved in the competent courts of that jurisdiction.
European Union users. You may also rely on mandatory consumer-protection laws of your country of residence. The European Commission's online platform for online dispute resolution is available at ec.europa.eu/consumers/odr.
15. Changes to These Terms
We may update these Terms from time to time. The "Last updated" date at the top of this page reflects when the latest changes took effect. If changes are material, we will provide reasonable notice within the App or through the App Store listing. Continued use of the App after the effective date constitutes acceptance of the updated Terms.
